Recently, the representatives of the self-employed groups have achieved the commitment and the sufficient regulatory and legal frames to extend certain Government aid to the self-employed affected by COVID-19, as well as the creation of new aid that will extend beyond 30 of September. We consider below the different cases in which a freelancer can be found today.

SCENARIO 1. You have received the benefit until the month of September (Additional provision fourth Royal Decree-Law 30/2020).

Your case is the following, you were granted the benefit until June 30. In the month of July, as you expected that your billing in this third quarter would be below 25% of the billing of the third quarter of 2019, you reapplied for the benefit and it was granted again, so you have collected the benefit In September.

What requirements must I meet?

  1. Maintain during the fourth quarter of 2020 the requirements that were established for its concession
  2. Be affiliated and registered on July 1, 2020 and remain registered while the benefit is being collected.
  3. Be up to date with the payment of social security fees.
  4. Your billing in the third and fourth quarters of 2020 must be below 25% of the turnover you had in the third and fourth quarters of 2019.
  5. The net returns (income less expenses) for the third and fourth quarters of 2020 cannot exceed € 5,818.75, each, and each month cannot exceed € 1,939.58.

Until when will I receive this benefit and how much will I receive?

This benefit ends on January 31, 2021, and you will receive 70% of your contribution base (you will continue to receive what you have been receiving until September 30).

Will I have to pay the freelance fees during those months?

Yes, Social Security will charge you your self-employment fees, but the Mutual Society will pay you along with the benefit the amounts of the fees.

Do I have to do something?

Yes, you have to request this extension at your Mutua.

SCENARIO 2. You received the benefit until the month of June, but you did not request the continuation because you anticipated that in the third quarter your billing would be higher than 25% of the billing you had in the third quarter of 2019 (Additional provision fourth Real Decree-law 30/2020).

What requirements must I meet?

In addition to meeting the requirements related to the previous scenario, you must have quoted for 12 uninterrupted months due to cessation of activity (from October 2019 to September 2020).

Until when will I receive this benefit and how much will I receive?

This benefit ends on January 31, 2021, and you will receive 70% of your contribution base (you will once again receive what you were charging until June 30).

Will I have to pay the freelance fees at social security during those months?

Yes, Social Security will charge you your self-employment fees, but the Mutual Society will pay you along with the benefit the amounts of the fees.

Do I have to do something?

Yes, you have to request this new benefit at your Mutua.

SCENARIO 3. Your business is closed as of October 1 (art. 13.1 Royal Decree-Law 30/2020).

You receive a resolution from the competent authority forcing you to suspend all your activities as a containment measure in the spread of the COVID-19 virus. In this situation, you have the right to request a termination of activity benefit of an extraordinary nature.

What requirements must I meet?

  1. Be affiliated and registered 30 calendar days before the date of the resolution of the suspension of activities.
  2. Remain registered while the benefit is collected.
  3. Be up to date with the payment of fees.

Until when will I receive this benefit and how much will I receive?

This benefit will end on the last day of the month of the end of the suspension of activities, and you will charge 50% of the minimum contribution base that corresponds to the activity carried out.

Will I have to pay the freelance fees during those months?

No, you are exempt from the obligation to contribute.

Do I have to do something?

Yes, you have to request this new benefit at your Mutua.

SCENARIO 4. I have not contributed for cessation of activity during the last 12 months (art. 13.2 Royal Decree-Law 30/2020).

Here are 2 freelance profiles:

  1. Those self-employed who, when registering with the flat rate, chose not to contribute due to cessation of activity. For example, any self-employed person who registered during 2019 with a flat rate.
  2. Those self-employed who have been contributing for less than 12 months.

What requirements must I meet?

  1. Not being entitled to the benefits that we have explained in scenarios 1 and 2.
  2. Be affiliated and registered before April 1.
  3. Remain registered while the benefit is collected.
  4. Be up to date with the payment of fees.
  5. Not having income above the SMI during the fourth quarter of 2020.
  6. The turnover for the fourth quarter of 2020 must be below 50% of the turnover generated during the first quarter of 2020.

Until when will I receive this benefit and how much will I receive?

This benefit ends on January 31, 2021, and you will charge 50% of the minimum contribution base that corresponds to the activity carried out.

Will I have to pay the freelance fees during those months?

No, you are exempt from the obligation to contribute.

Do I have to do something?

Yes, you have to request this new benefit at your Mutua.

 

It is very important that you know that as of March 1, 2021, all provisional resolutions adopted on these dates will be reviewed, and the amounts unduly received will be claimed from those self-employed who do not meet all the requirements.
